Description

To Whom It May Concern: This acquisition was conducted under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Government-Wide Acquisition Contract (GWAC). The resulting Firm-Fixed-Price delivery order (DO) was competed among eligible Service-Disabled Veteran-Owned Small Business (SDVOSB) NASA SEWP V contract holders. The Department of Veterans Affairs (VA), Office of Information and Technology, VA Informatics and Computing Infrastructure requires brand-name Pure Storage X90 FlashArray and FlashBlade hardware, controller upgrades, storage infrastructure expansion components, cabling, accessories, maintenance, and associated support services. The brand-name restriction was authorized as an exception to fair opportunity pursuant to 41 U.S.C § 4106(c)(2), as implemented by Revolutionary Federal Acquisition Regulation Overhaul (RFO) 16.507-6(b)(2). The required supplies and services are unique or highly specialized, and only the specified brand-name solution can satisfy the Government's requirements at the required level of quality. Note: VA s Electronic Contract Management System FAR 6.302-1(c) Brand Name selection is being used because the system does not yet include the applicable RFO Part 16 brand-name/exception to fair opportunity selection. The authority listed in the approved Justification for an Exception to Fair Opportunity governs this NASA SEWP V DO. In accordance with the applicable RFO posting requirements, the VA is providing the redacted Justification for an Exception to Fair Opportunity for this acquisition. The justification, which outlines the Government's rationale for supporting the brand-name restriction, will be made public following the award. The resulting DO was awarded under NASA SEWP V GWAC after receiving quotations from eligible SDVOSB contract holders.
